Procederá el sobreseimiento provisional: 1.º Cuando no resulte debidamente justificada la perpetración del delito que haya dado motivo a la formación de la causa. 2.º Cuando resulte del sumario haberse cometido un delito y no haya motivos suficientes para acusar a determinada o determinadas personas como autores, cómplices o encubridores.
