Benidorm has a residential and tourist population that is largely foreign, particularly British, Dutch and Norwegian. The language barrier is one of the principal problems in an arrest: the detainee signs documents without understanding them, gives statements without proper guidance, or accepts plea bargains that compromise their freedom and residency status.

Benidorm has its own judicial district, based at Avenida Beniardá, comprising the Courts of First Instance and Investigation and also serving nearby municipalities (La Nucía, Polop, Finestrat, L'Alfàs del Pi and Altea). The investigation of offenses and the fast-track trials are handled by these courts and by the Benidorm duty court, where the first steps after an arrest take place.

When the offense is serious —carrying more than five years' imprisonment— or an appeal or jury trial applies, jurisdiction transfers to the Audiencia Provincial de Alicante, at the Ciudad de la Justicia in Alicante. The second instance against the Audiencia's judgments lies with the Civil and Criminal Chamber of the High Court of Justice of the Valencian Community, and cassation with the Supreme Court. We coordinate every step —Benidorm, Alicante or, where applicable, Madrid— with specific travel for each hearing, with no need for the client to hire a local correspondent.

The high presence of foreign visitors and residents means arrests of people who do not speak Spanish are frequent in Benidorm. Every foreign detainee keeps the rights of Art. 520 of the Criminal Procedure Act and, in addition, specific rights: a free interpreter in all proceedings (Art. 520.2.e), translation of decisions affecting their liberty, and consular assistance, with notification to their country's consular office on request.

• Do not sign or testify without fully understanding the content and without legal assistance.
• Hasty plea bargains: a plea accepted "to get out sooner" generates a criminal record with effects on residency and future travel within the Schengen area.
• Tourists who have already returned home: the proceedings may continue through procedural representation, video-link testimony (Art. 731 bis LECrim) or letters rogatory, often avoiding a return to Spain.
• Convicted non-residents: for sentences over one year, Art. 89 CP allows replacing imprisonment with expulsion, a decision requiring a prior hearing and an assessment of ties to Spain.

Controlling the language and the safeguards from the first hour is decisive to prevent the language barrier from turning into an avoidable conviction.
