The Benidorm Judicial District and the Audiencia Provincial de Alicante

When the offense is serious —carrying more than five years' imprisonment— or an appeal or jury trial applies, jurisdiction transfers to the Audiencia Provincial de Alicante, at the Ciudad de la Justicia in Alicante. The second instance against the Audiencia's judgments lies with the Civil and Criminal Chamber of the High Court of Justice of the Valencian Community, and cassation with the Supreme Court. Arrest of Tourists and Foreign Residents: Your Rights
The high presence of foreign visitors and residents means arrests of people who do not speak Spanish are frequent in Benidorm. Every foreign detainee keeps the rights of Art. 520 of the Criminal Procedure Act and, in addition, specific rights: a free interpreter in all proceedings (Art. 520.2.e), translation of decisions affecting their liberty, and consular assistance, with notification to their country's consular office on request.

- Hasty plea bargains: a plea accepted "to get out sooner" generates a criminal record with effects on residency and future travel within the Schengen area.
- Tourists who have already returned home: the proceedings may continue through procedural representation, video-link testimony (Art. 731 bis LECrim) or letters rogatory, often avoiding a return to Spain.
- Convicted non-residents: for sentences over one year, Art. 89 CP allows replacing imprisonment with expulsion, a decision requiring a prior hearing and an assessment of ties to Spain.
