Important: a sale need not be proven. Possession pre-ordered to trafficking is enough: if the quantity exceeds personal use (more than 7.5 grams according to Supreme Court case law), or there are indications of sale (scales, individual bags, divided cash), the intent to traffic is presumed.

2. Notable Quantity: 6-9 Years (Art. 369.1.5 CP)

The aggravating factor of notable quantity is triggered from 750 grams of PURE cocaine (not gross weight). This distinction is crucial for the defence: the police weigh the drug gross (with adulterants); 1 kg of cocaine cut to 30% contains only 300 grams of pure substance. If purity is low, the pure weight may not reach 750 g, and the aggravating factor disappears. Requesting the purity analysis is the first defence.

3. Criminal Organisation: 9-12 Years (Art. 369 bis CP)

Where trafficking is carried out within a criminal organisation, Art. 369 bis CP does not raise the penalty by one degree: it sets its own range of 9 to 12 years in prison and a fine of up to four times the value of the drug. Leaders, managers or administrators of the organisation receive the next higher degree: 12 years and 1 day to 18 years. The extreme-gravity cases of Art. 370 CP (use of vessels or aircraft, international networks, or quantities far above the notable-quantity threshold) raise the Art. 368 penalty by one or two degrees, up to a ceiling of 13 years and 6 months. In the National Court's major cases, the defence of individualisation — separating the accused's conduct from the whole — is fundamental: being present is not participating.

4. Personal Use vs. Trafficking: the Red Line

Possession for personal use is not a criminal offence in Spain. It is an administrative infringement punishable by a fine (Art. 36.16 LO 4/2015). The Supreme Court sets 7.5 grams as the quantity of cocaine compatible with personal use. The defence can rebut the presumption of trafficking by proving habitual use (hair analysis, addiction treatment records) and the absence of indications of sale.

5. Defence Strategies in Cocaine Trafficking

1. Purity analysis — the first battle. If purity is low, the notable-quantity aggravating factor disappears: 3 years less in prison.

2. Nullity of wiretaps — in most major cases, intercepted communications are the key evidence. If the court order authorising them lacks sufficient reasoning, all derived evidence is null: the fruit of the poisonous tree doctrine.

3. Chain of custody — from seizure in the street to the laboratory: is everything sealed? Do the weights match? A break invalidates the material evidence.

4. Individualisation in major cases — being in a vehicle with drugs does not prove the person knew what was being transported. The burden of proof lies with the prosecution.
